Who's in the Wrong?

Bought some furniture on March 3rd. I was told by the sales rep/manager that it would take 4-6 weeks for delivery. I waited almost 8 weeks and never heard a word so I went back to the store and the manager said the reason it was taking so long was because they originally sent the wrong purchase order number to their vendor, and that it would be another 7-10 business days. I told him this was unacceptable and just wanted my money back. He agreed and said I would receive a check in three business days.

Yesterday he called me and said he could not refund the money, but could give me store credit. I told him I just wanted a refund and he said he would call me back. Today a different manager called and said they could issue me a refund minus a 20% restocking fee (almost $300). They are trying to use the excuse that they are losing money because they still had to purchase the furniture from their vendor. I said that's not my problem, I bought the furniture from them...not their vendor. They can still sell it to someone else and still profit.

Any suggestions on what my next course of action should be? Im sure someone here will try to twist this and claim its somehow my fault and I should have to pay the restocking fee...

It's absolutely their screw up. And there shouldn't be a restocking fee because it's never been de-stocked.

Accept the extra 7 to 10 days but demand a store credit for your troubles.

The receipt says that the furniture can only be returned for store credit or a refund minus a 20% restocking fee from the time it was shipped. I dont know if that means shipped to me or them, it doesnt say. They told me two days ago that it hadnt even been shipped to them yet but today they are saying their computer shows it as "in shipping"...whatever that means.

As for your second question...really? Its the principle of it. They weren't offering me anything, why should I wait over 2 months for furniture that was supposed to only take 4-6 weeks?

Honestly, that's my question, too. If it's annoying, it seems like a good solution would've been to ask for a small discount or get a gift certificate or something. But screwups happen sometimes, and it seems like this isn't a huge one in the grand scheme of things.

Yes, in as much as you may have to fight off legal claims. Any time you wind up with legal claims you're in a gray area where you can lose even if you're right.

As to the original point: They're clearly wrong. However, if they're claiming you owe a restocking fee then that must mean they either have the furniture or it's near being delivered. Do you still want it? Are you refusing delivery just because you're pissed off at the retailer?

20% restock is pretty common. If its the dealers **** up you shouldnt have to EVER pay the fee.
Ive been doin this for along ,long time and never passed a restock fee onto the customer.
