Chad Johnson gets 30 days in jail for probation violation

Not since Vincent LaGuardia Gambini found himself repeatedly in contempt has the lack of courtroom decorum had such dire consequences.

According to Local10.com, former NFL receiver Chad Johnson appeared in court today in connection with allegations that he violated probation by failing to keep in touch with his probation officer. Though prosecutors initially wanted Johnson to be jailed for the infraction, a plea deal was reached.

Under the terms of the agreement, Johnson’s probation would have been extended to December 21, and he would have performed 25 hours of community service.

“You better thank your lawyer. He did a great job for you,” Broward Circuit Court Judge Kathleen McHugh told Johnson after accepting the agreement.

Johnson responded by slapping attorney Adam Swickle on the butt. Which prompted the judge to call the whole thing off.

She believed Johnson wasn’t taking the situation seriously, so she rejected the plea deal and sentenced him to 30 days in jail.

Johnson pleaded no contest last year to battery of his wife, who has since divorced him. He was cut by the Dolphins in the aftermath of the arrest.

The good news is that he’ll be free in time for training camp. The bad news is that there isn’t, and won’t be, a training camp to attend.

The chief law enforcement officer in Florida has expressed dismay at the knee-jerk reaction that put former NFL receiver Chad Johnson behind bars for patting his lawyer on the butt.

Florida Attorney General Pam Bondi tells TMZ (who else?) that Judge Katherine McHugh went too far in jailing Johnson for 30 days in response to his courtroom antics.

“Although we never condone domestic violence, this event seems to question judicial temperament, not the subject matter before the court,” Bondi said.

Many believe Johnson is behind bars for domestic violence. He’s not. He was thrown in the hoosegow (all-time favorite word No. 6) specifically for the quick smack to the rear end of his lawyer, after Judge McHugh told Johnson he should be grateful for the lawyer’s efforts. Without the smack in the butt, Johnson would be free.


Bondi has no jurisdiction or authority over McHugh or any other member of the judiciary. Presumably, the Florida Supreme Court could take action, if the Florida Supreme Court so chooses.

We think it should. Apart from the unfair outcome, Florida taxpayers now have to bear the costs of an incarceration resulting from a judge getting her noise out of joint over a hand to the ass.

At a minimum, that’s money that could otherwise go to upgrading the stadium where the team that cut Johnson plays.

Johnson’s formal request for a reduced sentence, made in writing to Judge McHugh, remains pending.

Chad Johnson out of jail today after butt-slap incident

Chad Johnson is going home from jail today, one week after a Florida judge sentenced him to 30 days behind bars after he slapped his male lawyer on the rear during court.

Johnson reportedly appeared in front of Broward County Circuit Judge Kathleen McHugh again this morning, in handcuffs. TMZ reports that the judge blasted him again for his disrespectful behavior in front of her.

Then she agreed to release him from jail, but added a month to his probation time.

"I just wanted to apologize for disrespecting the court last time," Johnson told the judge. "I apologize. I did have time to reflect on the mistakes I made in this courtroom."

To recap ...

Last Monday Johnson, formerly known as Ochocinco, stood in front of McHugh for a recent probation violation in the domestic violence case concerning ex-wife Evelyn Lozada.

He’s on probation after pleading no contest to head-butting reality TV star Lozada during an altercation last August.

(During today's hearing, the judge called what he did to Lozada “horrific.”)

When McHugh asked Johnson if he was satisfied with his lawyer, Adam Swickle, Johnson playfully reached out and slapped his lawyer’s butt, which sent the judge into a tizzy.

“I don’t know that you’re taking this whole thing seriously. I just saw you slap your attorney on the backside. Is there something funny about this?” the judge asked angrily.

“The whole courtroom was laughing. I’m not going to accept these plea negotiations. This isn’t a joke.”

Johnson tried to apologize, but McHugh would have none of it, sending Johnson off to jail for 30 days on the probation violation.

Public consensus seemed to be that McHugh had gone overboard with her actions.

In court today, Swickle said that Johnson would fully comply with all the probation conditions and that he even hopes to play football again. The Miami Dolphins cut the six-time Pro Bowler after he was arrested last summer.

"He understands that this is the kind of situation that can derail a person's career," Swickle said. "We're very confident he will do what he should do."
