TAOS, N.M. (KRQE) - A simple traffic stop turned into a wild scene with a 14-year-old rushing a state cop, a high-speed chase and another officer firing at a fleeing minivan full of kids.Now the driver and her son are facing charges while New Mexico State Police are investigating the officers involved.

It all started Oct. 28 on a state highway south of Taos. A State Police officer pulled over Oriana Ferrell's minivan for going 71 mphr in a 55 mph zone. In the minivan with her were her five kids. The Taos News reports the children range in age from 6 to 18. On dash cam video you can see Ferrell and the officer argue after Ferrell couldn't decide whether to pay the $126 fine or contest it in court. The officer instructs her to turn her vehicle off and stay put before walking back to his car.But.

Ferrell drives off instead and the officer has to pull her over again. He doesn't appear happy as he approaches the driver's side door of the minivan.The officer yells for Ferrell to get out several times before reaching into the minivan to try and pull her out.In the dash cam video,
you can hear her children yelling for the officer to leave their mom alone and get off of her.

At one point Ferrell's 14-year-old son gets out of the minivan and starts walking towards the officer, but the boy thinks better of it after the officer draws his Taser and points it at the boy. He gets back in the van while the officer continues his struggle to get Ferrell out of the minivan."Look, I'm going to ask you one more time to get out of the vehicle and then I'm going to pull you out, OK?" the officer said. "You're already facing evading charges. You ran away from me.""Sir, I pulled back over, I didn't run away," Ferrell responded. "You see my children. I'm not doing anything wrong. I'm just trying to take them to the Rio Grande."

Finally, Ferrell agrees toget out and talk with the officer behind the minivan. The conversation
doesn't last long. When the officer tells her to turn around, Ferrell bolts back towards her minivan. The officer grabs her and a struggle ensues.That's when her 14-year-old son gets out of the car again and rushes the officer.

The boy and the cop have a short tussle. The officer draws his Taser again while the boy runs back into the minivan and closes the door.As backup officers pull up, the officer pulls out his baton and smashes one of the rear windows as the family screams
again. The minivan speeds off while another officer fires what appears to be three shots at the fleeing vehicle.Ferrell leads State Police on a high-speed chase into Taos before giving herself up in front of a hotel.

Ferrell and her 14-year-old son are both arrested. The mother gets child abuse and fleeing charges as well as a misdemeanor for possession of drug paraphernalia. The Taos News reports that State Police claim they found two marijuana pipes in the minivan. Her son is charged with battery of an officer.The family is reportedly from Memphis and was visiting New Mexico on an educational trip.

State Police are not releasing the names of the officers involved but say
they are both under investigation for the incident.

I do have an issue with the officer running into the frame and putting three shots through the back glass of the minivan.

Officers should only be using deadly force in the event that the suspect poses an immediate health/safety risk to the officers and/or the public. At that point, they had no reason to believe she posed any greater threat for public harm that anybody driving recklessly. Reckless driving clearly does not allow for the use of deadly force.

I don't believe any of the officers involved in that scene behaved inappropriately...except for the dude that fired shots into the back glass. He's probably pretty damn lucky he didn't hit anyone.

I'm guessing there's a protocol that says to park at an angle along the side of the vehicle that's already fled once instead of in front of it to box it in?

I'm not a cop, and I don't know cop policy, but it seems like the golden rule should be that "cops don't shoot, they shoot back".

So I immediately wanted to come in here and be all like wtf to the Mom and the kid and the cop that shot his gun, but at least as far as the cop is concerned, I noticed the baton cop got scared by something right before the other cop started shooting. He fleed from the vehicle really quickly, so it's not outside the realm of possibility that a gun, a toy gun, or a gun looking object was pointed at him from inside the vehicle.

I'm not sure what the officer was doing at all. My concern is that I question whether or not he was either.

Besides, I'm gonna bet you any amount of money you'd like that this particular police department isn't training it's guys using Beverly Hills Cop videos. There's no way it's proper department protocal to try to shoot out the !@#$ing tires on a moving vehicle.

That's about a 1/100 shot when you're stationary, for him to be humped up on adrenaline and moving while trying to establish a proper base...yeah, that was essentially an impossible shot.

It was remarkably stupid.

He fled from the vehicle because he was getting back to his car to chase the moving van.

Besides, the guy that fired into the vehicle wouldn't have been at an angle to see that anyway.

That cop completely lost his cool. I'd be pretty comfortable with any of the rest of them in a foxhole with me; they were pretty levelheaded all things considered. That last guy, OTOH, is not the kind of personality I'd want to work in a high-stress situation with.

Remember - the difference between the great and the dead are often the ability to take that one extra breath and assess when all hell is breaking lose around him. This guy clearly lacks that ability.

....REALLY a bad idea is putting your kids at risk in today's whack a mole society.

.....situation could've end up in a lot of unfrotunate ways...over a speeding ticket.

Can't argue with that at all. I'm not agreeing with what the cop did at all, nothing there warranted gunfire. I was just trying to make a suggestion as to what he may have been thinking (I know nothing about police work either).

Well, yeah, that too. Another good rule that was broken here is to never flee the police when your kids are in the car.

I've carried a gun with the need to use it on occasion. That said, these cops are waaaaay to trigger happy. Even during a freaking war we used better judgment with when and how to use our weapons. I know most cops are good at what they do, but there is a small fraction that just need to only carry one bullet in their shirt pocket, or join Farva on radio detail.

That kid's dumb as a hammer and if it wasn't this incident that put him in jail, he had one coming within the next few years. This wasn't some gentle lamb going to defend him mom, that kid was looking to rumble with a damn cop. If he doesn't get in the middle of it, his mom ends up with a simple obstruction charge and maybe the cop even lets he go; unlikely, but possible.

But to say he's the only one in the video that's not an idiot (which I disagree with; only one of those cops behaved poorly) is giving him a complete pass.

Yeah, if I was the prosecutor I'd probably go a little lighter on him due to his age. What he did was dumb, but this is a case where a reasonable fourteen year-old might use poor judgment. However, whatever I take off of his sentence I'd add to the mother's sentence because she's an absolute moron. She put her son in that situation by having the IQ of a semi-rotten kumquat.

And I'm curious. I just now watched the video. We see the one cop shooting from the rear, but it looks like the cop on the right (out in the weeds) also pulls his gun. Based on the report it appears that he was smart enough to not shoot, but I thought it was interesting.

I mean, really, people. Just pay the ticket or fight it in court. This is how people get killed and/or go to prison. It's a speeding ticket.
