Civil case? Maybe. I'm not sure if there's a rebuttable presumption in a situation like that, but there are in many instances so it wouldn't surprise me.
In a criminal case? Nah - no chance. Simply being present during the wreck of a car you own isn't going to create a presumption that you were driving it. Rebuttable or otherwise. I doubt it would even be Constitutional to create a presumption like that in a criminal case.
In a civil one - who gives a shit? It ain't my money.
