KC’s Allen will serve jail time

Chiefs defensive end Jared Allen was ordered Wednesday to serve 48 hours in jail after a judge revoked a diversion program related to driving under the influence of alcohol.

Allen, who was found guilty of the charge of driving under the influence, will enter the Johnson County Jail for a 48-hour period beginning at 6 p.m. Feb. 16. As part of a plea agreement, Allen was placed on probation for one year and fined $500. The penalty includes a suspended sentence of 90 days in jail. If Allen violates his probation, he will be subject to serving the full sentence.

Allen, 24, was granted diversion in July after being stopped at 5:37 a.m. May 11 at 135th Street and U.S. 69 in Overland Park. Typically, if such a court program is completed successfully, the charges are dismissed.

After Allen was charged Sept. 26 with driving under the influence in Leawood, Overland Park prosecutors filed a motion to terminate the diversion program. That was granted Wednesday upon Allen being found guilty.

Allen is expected to be in court on the Leawood charge on Feb. 14.

Yep, he deserves it. He's lucky he only got 2 days, my friends dad got 2 dui's last year, and did 5 months in jail. Allen got it easy.

He did get probation and a 3-6 month suspended sentence as well, so if he screws up, then he will do more time.

Just stupid, and also means no Allen for 4 games at the start of next year.

I thought the 4 game suspension was predicated on whether or not he was already involved in the NFL substance abuse program.

If he wasn't previously entered into the program, would he still draw the suspension.

That is the substance abuse program. The legal issue do not have such a distinction. They can suspend him for only 1 game if they wanted. He has 2 convictions now, he will get suspended for it, and since it involved alcohol, he'll also be enrolled in the substance abuse program, probably as the 1st offense category since they happened so close together. They don't retroactive the offenses, I don't think. Can't come in and say oh, you already have 2 strikes, so you go straight to phase 2. Very well could be mistaken though, that's just my interpretation based on history (see warfield, they missed one of his arrests, so his 3rd arrest only got him the 2nd phase penalty, rather than jumping straight to the 3rd offense category).
