Legal question for you...well...lawyers on here.

Okay, as many people on here know, I was a complete idiot last year and cosigned for a car for my then boyfriend, who turned out to be a total loser. Well, he hasn’t made a car payment for May, June, and now July. The bank called me at work today and informed me that I am the primary on the loan, asked me where it was at, and asked if I knew what a repo would do to my credit. I sent a text to the ex: Turn in the damn car. At least save me repo fees. I will call and report it stolen if I need to.

So, I am ultimately financially responsible for this car. All I have for my ex is a phone number and the city where I knew he last lived (but I believe he’s still there). What are my legal rights here? I do not have a key to the car, so, even if I found it, I couldn’t move it or turn anything into the bank. If they have to come and get it, I’m getting repo fees, and I’ve been informed that I will be financially responsible for paying the difference in the amount owed and what they can get for the car. I’m in possession of the title, so I have no problem turning it over. What will reporting it stolen do for me, as his name is also on the title, and he has it registered under his name?


UPDATE: Crisis diverted....for now. He made a payment today with a promise to make another one on the first of next month.

Yes, I fully suspect people will call me an idiot, like I don't already know I was and have to deal with that fact on my own. I hope people will realize I'm looking for options, as I don't know what mine are in this situation. This is good advice. You report a car stolen that's not and you can add legal issue's to your problems.

If it was me personally, I would go take the car. Hire a tow truck and have it driven to an shop to get keys made. Sell it and hopefully it has enough value to pay back some of the loan. Then setup to make payments on the difference and consider it a lesson learned.
