Gonna be a tough case to prove unless there was some sort of negligence on their end. Good luck though.

They didn’t have anything that you signed releasing them of that liability? Seems strange for a big corporation like pet smart to not have something like that covered in a contract before the pets are dropped off. I’m not trying to say what they did was right, but legal recourse seems hard against a big corporation like petsmart. Best of luck to you, and most importantly hope your dog is able to fully recover soon.

Details,

we dropped off our two dogs at PetSmart pet hotel in Cary North Carolina on the 10th of December so we would drive to Port Canaveral FL, we left on our cruise on the 11th. On the 16th why we were in San Juan, my wife received a call stating that diesel my pointer beagle mix was limping. They said that when they took him out in the morning he was not limping and when they went to go get him for afternoon playtime he was not using his leg and limping. They took him to Banfield pet hospital for X-rays, the X-rays shows that he had a spiral fracture of his femur bone. The manager said they reviewed the footage to see how he did this but there is no footage of this. So they took him to emergency vet care in order for him to get on pain meds. They did pay for that stay but are refusing to pay for the surgery. the ortho surgeon did a bone biopsy to make sure it's not cancer and he does not have cancer, there is also no underlying condition that would cause his femur to facture.

Nope, they had nothing of that to sign at all.
I re-read all the paperwork we signed and nothing at all about an issue like this.

Emailed the CEO explaining everything and what I was in the process of doing and a check is on the way.

Yeah….they’re going to pay if it’s not a huge amount instead of going to court.

Sounds like the kind of human interest story the local news media would jump on. You might want to reach out to somebody at your local TV station.

Bad press will get you compensated much quicker than any lawyer.
