Man could sue the county for driving his car into a flooded creek

The incident began Sept. 12 when Ortiz was driving to work. His vehicle hit part of a washed-out road and then plunged into a creek...

Ferszt said the county should have closed the road during floods in September. He said the first responders were also included because they did not realize Ortiz was trapped in the car until they prepared to lift it out of the water...

Since the accident, Ortiz has racked up $40,000 in medical bills and still has shoulder issues and trouble sleeping, including a recurring dream of shivering to death, Ferszt said.

Whether a future lawsuit is filed will depend "on Roy's medical treatment and how that pans out," Ferszt said.

You can actually blame the national media for that one. That lawsuit was far from frivolous, but that is how the national media played it out, and thus why most Americans believe it to be so.

Yeah the back story on that case sheds a lot of light on why it came out the way it did.


It's a tough topic. You have to hit these large corporations with large enough amounts to be genuinely punitive. At the same time it becomes lottery ticket for every slime bag out there.

A New Mexico civil jury awarded $2.86 million to plaintiff Stella Liebeck who had suffered third-degree burns in her pelvic region when she accidentally spilled hot coffee in her lap after purchasing it from a McDonald's restaurant. Liebeck was hospitalized for eight days while she underwent skin grafting, followed by two years of medical treatment.

...The trial judge reduced the final verdict to $640,000

...but the parties settled out of court for an undisclosed amount less than $600,000.

I was reading about the hot coffee thing a few weeks ago. It's kind of become this rallying cry for people complaining about us turning into a litigious society, but in actuality, that woman suffered horrible burns that required skin grafts and shit. I can't remember all the details, but it was a legit claim.
