Based on what you have said in this thread, if your neighbor threatened your grand kids and their friends I don't think you'd be inclined to be a nice guy when it came to handling this situation about the sewer line.
If you are the OP, How do you approach this guy and present the problem you want solved? |

I didn't think anything of it at first, but I was talking to a friend of mine who is a real estate agent, and he was really worried about that for both our sake. Option B: You have 30 days to get this fixed or I'm capping it off. Also, **** your dog. -- I'm not saying my version of Option A is perfect, but OP seems intent on going in guns blazing when he doesn't actually even know what the situation is. If you've consulted with a lawyer who can figure out what the actual options are and found that the only way out of it is by separating the lines, it is what it is. But there's zero reason to just drop this on someone when there's absolutely no rush on this at all. People usually don't have $10k just lying around, and forcing someone to come up with it out of nowhere like that is, again, and epically dickish move. |

It sucks that it's not "fair," but it's not like that's unheard of. I own the fence that gives my neighbors some extra privacy. They own the tree that shades my yard. I don't expect them to chip in for the fence when the time comes, and they don't expect me to pay for their tree to get pruned. I'm just hoping we get updates on how this turns out. In some states there are statutes relative to shared maintenance on a shared fence & in some it falls on the owner. The law is settled here but it doesn't transfer to other structures on the property or oopsy surprises like this. That can't be said here in a situation where there's twice as much outflow contributing to incremental w/t on the OP's drain line. Not to mention the fact that ITT there's abundant evidence from what the city is apparently telling this dude in regards to this issue in that he is not only not stuck but can require the neighbor run his own line. I did like your suggestion to approach the dude in a friendly manner & give him time to come up with the $ to construct his own drain line. My only addendum to that would be to send a certified letter with a return receipt confirming the conversation & timeline. & I also agree that escalation typically never works out & should be avoided to the extent its possible. Nothing to do with your commentary but OP is getting run through the wringer ITT unnecessarily IMO. It's clear once details were provided he acted reasonably with respect to the dogs. |

Again, FTR, I do not like how he's been a dick about this, but as I stated many times, the dog, his health, his medications, I get it to a degree, but leave the kids out of it! But if he wants to continue being a dick, I'll dick him right back to where he see's his own shit coming out of his shit hole!
