Man could sue the county for driving his car into a flooded creek

The incident began Sept. 12 when Ortiz was driving to work. His vehicle hit part of a washed-out road and then plunged into a creek...

Ferszt said the county should have closed the road during floods in September. He said the first responders were also included because they did not realize Ortiz was trapped in the car until they prepared to lift it out of the water...

Since the accident, Ortiz has racked up $40,000 in medical bills and still has shoulder issues and trouble sleeping, including a recurring dream of shivering to death, Ferszt said.

Whether a future lawsuit is filed will depend "on Roy's medical treatment and how that pans out," Ferszt said.

Yeah, I watched a documentary on it a few months back. Due to the world-wide attention brought on by our lovely media and late-night comedy shows, who completely twisted and turned that story to make the lady seem like the money-grabbing villain, she lived as a recluse in her home for several years following the ordeal. It's really quite sad when you hear her side. She was this sweet, typical grandmother that lived several years of her life in complete hell.

Btw, here's my opinion on the OP. We are lacking a lot of information to pass judgement. The part of the lawsuit against the rescuers seems dumb. However, if it came to light that the rescuers surmised that no one could possibly be alive while standing around on the shore joking and talking about last night's basketball game, when they could have safely performed a check for signs of life prior to them starting to tow the car out of the water, then there might be some merit there. The part of the lawsuit against the county not closing the roadway could have some merit as well. If the county knew that this particular stretch of the roadway was prone to flooding and they neglected to make necessary improvements or post signs warning drivers of possible flooded roadways, then again there could be some merit.

The great thing about it, believe it or not, our civil justice system actually works quite well in America. Much better than our criminal justice system. If this is a frivolous lawsuit, then it will not standup in court.

I wont rush to judgement as I know the media is bias and usually only has 20% of the facts. It kind of sounds like there were people(divers) at the scene for a while and no one bothered to check if the car was empty. I'm pretty sure if that was your family that was in there for 2 hours you'd contemplate suing someone as well.

The McDs lawsuit led to this: http://en.wikipedia.org/wiki/Stella_Awards. It was a bullshit lawsuit, but I am glad she got medical treatment. If we ever wise-up and go to a single payer system...these lawsuit would probably cease.
