I had what I felt was a wrongful ticket

So I've never had a ticket in my entire life. I understand it happens. I drive home somewhat late every Wednesday because the boys and I do a podcast that night every single Wednesday for the past 2 years. Therefore I understand I'm more of a target on the road being that there's less traffic, and that's fine.

I was leaving Quik Trip in Lenexa, and getting onto a highway to head west towards my house. I was shortly afterwards pulled over by Lenexa PD (In training) to cite me for an illegal wide turn. I have driven the same way since I was 16 years old. Never once had an issue with the way I turned. Anyways they pulled me over and accused me of also not using my turn signal which also added to my "illegal lane change". I've been furious and I requested the video evidence which I paid $35 for. Of course the evidence shows nothing of the actual violation that they sent me. Only the actual stop of my vehicle. I also noticed on my police report they wrote down my wrong address and as well as the wrong date of the stop. The said June 7th instead of July. I don't know if those things matter or not.

So anyways my question is, as I believe this is a bogus claim by these officers, what's the best options to win on this ticket? Those of you with experience I'm curious of your thoughts. The video here really makes no difference but I'm posting it here anyways. And it's extremely boring past the stopping point.

In an interesting coincidence, I'm on the road today and just passed the biggest speed zone I think I've ever seen. I saw 7 highway patrol cars over the course of about 20 miles. I suspect there may have been more that I didn't see. You can bet that everybody was driving one mile below the speed limit by the time they hit the halfway point.

Not 100% sure but I'd start with contacting the clerk of the court you're in.

You may have to provide proof of hardship with the original date or something.

You can show up to the first date and ask for a continuance.

The funny part is, I didn't even notice the date was wrong when I showed up to court. I didn't have to say a word.

It might depend on when the prosecutor requests leave to amend. Could vary with rules of procedure for the particular court. If prosecutor moves to correct date before putting on evidence, that would be granted. If move to amend after calling first witness, could be denied but more often granted. If move to amend after prosecutor has rested case in chief, better chance it is denied.

I don’t think they will care about the incorrect date, especially when the video evidence that was purchased for $35 shows the correct date. Get a lawyer, pay the money now, and then find a way to cheat on your state/federal taxes at the end of the year to get that money back.

Lenexa is a big enough city for court to meet often and officer would not be told to be there unless set for trial. It would not be set for trial for a few court dates unless you specifically ask for it to be and it would be scheduled according to officer’s schedule.

Hell yeah as you should battle it. From the video sure looked nothing wrong merging so you say it was before that and they didn't provide the evidence I've always heard innocent until proven guilty in the court of law. So the proof is on them to provide and it looks like they failed.

Not quite. They’ll have a hearing where the police officer who wrote the ticket has to show up. They batch em at the the court house.

If he doesn’t show up then you’re really in the clear because his testimony is the evidence. I have been lucky and had this happen to me.

The ticket is usually the charging document, so if date is correct on ticket, the mistake on the police report would not be a basis for a dismissal for a defect in putting defendant on notice of the charged offense.

The mistaken date in the police report would be evidence that is not that helpful for your defense.

If your defense is that you did not do the charged offense and you were stopped for training purposes, you should focus on that.

May be better to just do amendment maybe ask for lesser fine than normal amendment.
