Raiders' Henry Ruggs in fatal accident - will be charged with DUI resulting in death

Update: Not a rumor, actually happened. Story developing.

Per TMZ: 10:27 AM PT -- A source close to Ruggs tells us the NFL'er is expected to be OK. The condition of the other people involved in the crash is still unclear.

Can we let this thread go. It’s terrible and the poor girl and her dog, eye witness’s saying they heard screams from her car. Let it go. We are better than this. He is not in the NFL anymore and we should move on.

It’s rare - but possible - for the charges to be served consecutively rather than concurrently. But most prosecutors in MO/KS seek concurrent sentences (served at same time).

Remember that each charge has a separate burden of proof, too. So if he’s charged with 10 crimes, they may only be able to prove 6 beyond doubt. Or 3.

Yeah, defense lawyers will reach to any extent possible to place blame on anyone else, even if it's a small fraction of blame... check your integrity at the door.

This case is national news. Any leniency given to Ruggs due to his standing as an NFL star will be met with harsh criticism. The fact that the girl was burned alive only adds to it. So sad.

I assume in the past they would charge someone with 1 or 2 and they would get dropped into lower level misdemeanors or whatever, so now if you have 10 ****ing charges, a plea of 2 or 3 looks amazing...... and each has a huge sliding scale of severity and being able to knock time off, etc. Very flexible for the infinite number of different situations, but also seems like there are far simpler ways to deal with the vast majority.

Anyway.... I don't know the "right" answer for number of years. I can definitely see the argument for 20 years being a really damn long time, he'd get out in his 40s or whatever and his career would obviously be far, far in the rear view mirror. Going in at 20whatever and getting out at 40+.... that's a long ****ing time.

OTOH.... play stupid games, win stupid prizes.
Merger doctrine generally sorts out the stacking issue. You can't typically be convicted of one crime if the elements of that crime are wholly subsumed by the bigger crime you're convicted of.

It's just the prosecution putting all their options on the table. Generally speaking it's largely sorted out if/when it goes to trial. It's kinda the inverse of the lesser included offenses rule. I don't care for that one, but I don't typically mind stacking since it mostly comes out in the wash if/when the matter is submitted to the jury.

You could use the “Ignore Thread” feature. Problem solved.

That's what they are paid to do. They dig for any possible angle to keep their client out of jail.

Prosecutors aren't much better, they will do anything to keep their conviction rate % up. They won't press charges against a huge scumbag if they might not get a conviction. They will destroy someone who didn't really do much if it's an easy case. Don't believe for a second that Prosecutors are looking out for the people. Most of them are looking to get a better job as a politician or get on a corporate retainer.
