Attorney question

So, as most of you know I got engaged this year. Well it isn't working out anymore and I will be moving back to where I was before.We moved into a house together in July with both of our names on the lease contract. Now, here's the question. She just sent me a message telling me to move my shit and leave or she would move it for me. Do I have to pay my half of the rent even though she kicked me out? I was just going to send the landlord my half when I moved out after the semester so I didn't get into trouble legally.

The landlord told me I was still liable to pay my half even though she kicked me out. Is that true?

While this is probably true (she can't legally kick you out) you should probably get the heck out, anyway, before things get really out of control. You are much better off losing some money than living in a hostile, emotionally-charged environment. Seriously, just get your stuff and get out.

eh, I'd disagree with that. I believe that you can't truly know if you wanna be with someone unless you've lived with that person. remember, the things that are 'cute' about a person six months into a relationship turn into your major psychotic hatreds later on down the line. people are different in public than they are in private, and living with someone can allow you to get to know the person when it's all hanging out so to speak.

I realize it doesn't always work like that, but I lived with my fiance/girlfriend for 2.5 years prior to our wedding (we got married a few weeks ago), and our living together was a smooth transition into married life. nothing changed except for the officiality of it.

But, if you really want to be a dick and she kicked you out stop paying. She'll pay it or you'll both be evicted. If you've already been booted out, who cares?

I think I would have her arrested when she "moved" your stuff out. If your name is on the lease, it's half yours.

Bad idea if you care about your credit. The landlord could ding your credit and still pursue you for the money. Do this and you could end up paying more and having bad credit.

Your name is on the lease, you are a tenant and have a right to be in the house and also have an obligation to pay rent. She can't kick you out.

If she wants you out she needs to agree to pay your portion of the rent. This agreement needs to be confirmed with the Landlord as well and your name removed from the lease.

Oh yeah, grab the e-ring, that's yours too.

That's a quick, non-legalize answer.

YES.....She doesn't have the authority to absolve you of any financial responsibility to the contracting agent. The contracting agent only has that authority.

As long as you meet that responsibility(pay the rent), you can legally stay. She sounds pissed and you probably don't want to, you need "official" legal council.

I am not an attorney but I am 99% sure you are still responsible for any lease you signed, even if you decide to move out (for whatever reason). My advice to you is to pay the rent and see if you can't negotiate something with the landlord.

Oh, and whatever you do, stay the heck away from your ex. Even if you pay another six months rent on a place you no longer live in you are miles ahead of any divorce settlement you would have had in the future.
