Attorney question

So, as most of you know I got engaged this year. Well it isn't working out anymore and I will be moving back to where I was before.We moved into a house together in July with both of our names on the lease contract. Now, here's the question. She just sent me a message telling me to move my shit and leave or she would move it for me. Do I have to pay my half of the rent even though she kicked me out? I was just going to send the landlord my half when I moved out after the semester so I didn't get into trouble legally.

The landlord told me I was still liable to pay my half even though she kicked me out. Is that true?

IMO, she should leave too, and you need to break the contract. If the landlord isn't a complete dickhead he may let you out if you agree to pay rent until he gets it re-rented plus any reconditioning costs. Letting her stay is risky because you'd also be responsible for any damages to the place.

See, the thing is I moved down here for her and basically have no where else to go right now until next tuesday when my last class is over.

I know that she legally can't kick me out. But, as others have said, what's the point in being here if both of us are miserable.

As for sitting down at the table and discussing this like adults CDCOX, that's not an option...I've been trying to talk to her about all this for a couple weeks and she just ends up losing it.

I didn't want it to come down to this and knew a month ago I was moving when the semester was over.

One thing, she did say I didn't have to send all 275 of my half and only had to send her a 100. I'm afraid that if I did that and she stopped paying her side the landlord would come after me.

Our landlord is a complete dickhead. She already said if either of us stop paying she will go after which ever one it is.

Letting her stay....what if I take pictures of the place before I leave and give them to the landlord?

Your landlord is a business person, who has payments, taxes, insurance and maintenence costs, depending on the lease you've signed.

It depends on the terms of the lease ageement. Landlords are rarely have any clue as to the terms of their own lease agreements.

You should contact an attorney. There may be a student legal services at your school that will give you some advice for free.

Whatever you do, send all payments directly to the landlord and get a receipt for all payments.

Tell your ex chick that she needs to give you a release in writing for your half of the lease. If she is unwilling to do that tell her that she has to allow you to stay until she negotiates a new lease with the landlord.

If you are not worried about a bad credit rating just tell her (the landlord) to collect from the person living in the house.

OTOH, you are screwed.

If the landlord is a complete bitch as you say, she isn't going to give a shit about any pictures. You're responsible for it. I don't think it's even as simple as paying the landlord your half, if she doesn't pay her half you're still liable for it. She needs to leave too.

Re-reading your lease agreement would be a good thing right now, it should be noted somewhere what the penalty is for breaking it. I know it used to be in Nebraska that breaking a lease meant loss of sec deposit and the renter was liable for lost rent for up to 3 mos. But that was a long time ago and laws vary by state.

I am worried about my credit because I am just starting out. Don't want anything to screw my credit up.

I don't want to be allowed to stay...don't want to be here anymore then she does. She just has more going for her in this city then I do. So, I'm the one that said I'd move out and go back to where I was before we met.
