Manziel has a criminal record, so he's out. McMahon has also stated that every player will be required to stand for the national anthem, so I seriously doubt that Kaepernick will be involved.

Also, for a guy like Kaepernick, what's the incentive? He's still worth tens of millions and I seriously doubt that at age 32, he'll want to play for $15k a game or less.

McMahon is funding the league with $100 million dollars for 8 teams. After staffers, GM's, a 40 man roster for each team, etc., the paychecks will be less than what NFL Practice Squad players are paid.
