Owner of Rockstar Burgers charged with assault after pistol-whipping ex-girlfriend

KANSAS CITY, Mo. -- Platte County prosecutors charged the owner of a West Bottoms burger restaurant known for being open 24/7 with second-degree assault and armed criminal action on Friday.

Brian D. Smith was arrested on Dec. 6 and is being held in Platte County.

Court documents allege that Smith forced his way into an apartment, where he found an ex-girlfriend with in bed with another man. Smith allegedly pistol-whipped the woman, who is not named, causing her to bleed from her head. He also fought with the man before leaving.

Smith allegedly had choked the woman before, but she had not reported it out of fear.

Judge Abe Shafer signed the warrant for his arrest and asked that he be held with no bond.
