The difference between your example -- using a shoulder to pass in a motorcycle -- and 'a 6 car pileup' is a matter of execution and not sound decision-making. If anything, the motorcycle is far more dangerous to the rider than the incident with Rice.

Incorrect. I have ridden on the shoulder because of a pileup specifically because it was safer to both me and the motorcycle (air cooled). I've watched enough videos of people driving full speed into stopped traffic to know that isn't where I want to be while on a motorcycle.

It emphasizes my point precisely. People attempt that pass on the shoulder with some regularity and a great deal many of them fail to execute it. Some die for their efforts.

You missed the point. Completely. I'm not riding on the shoulder because I think it is cool to pass people that are stopped on a motorway. I'm not doing it to "stunt". I'm riding on the shoulder because I don't want to get splatted by someone not expecting stopped traffic on a highway. I'm riding on the shoulder because the bike will overheat if I stay there.

The decisionmaking process there isn't any better. Only the outcome. And you want to have it both ways - harping on what might have been in Rice's case and ignoring it in the instance of the motorcycle on the shoulder.

Yeah... it is. There was thought put into my action before taking it. A cautious weighing of circumstances, possibilities, and possible results/consequences.

We can clear that up REAL quick by my stating that I do not believe that in any way shape or form was what Rice did on that level of Murder or Rape... though it is certainly, IMO, on the same level as Burglary and Assault (which I also mentioned but you left off).

Stepping back from that... this kid ****ed up. Do I personally think he needs to go to prison for this? No one but the people in the car have enough information to say. Per legal council... I'm sure the police have gotten a very filtered via lawyer version of the events of that evening. I do, though, think most of us wouldn't have had the luxury of going home and having a lawyer speak on our behalf after several days. He got lucky he didn't kill someone or Brett Reid someone's kid.

Lastly, his statement that a motorcycle taking the shoulder during a pileup on a highway is the same decision making process Rice had that night.
