Are there any actual lawyers on ChiefsPlanet?

I think I need to hire a lawyer for my 16 year old son who got a speeding ticket for going 34 in a 20 school zone.

It is a church school that he didn't realize was a school, and on the description on the ticket, the officer clocked him before he was even 10 feet into the school zone. And he was sitting there waiting for a high school kid, because high school had just let out. I have literally driven down this road over 50,000 times in my life, at all times of day and year, and have never seen cop checking speed in this school zone.

The cop could have seen how nervous my son was, and been understanding about his lack of knowledge of the school, but he wasn't.

So, I need to hire a lawyer, and thought I would ask here first.

If you are not a lawyer, maybe you could recommend someone.

Thanks,

ChiefsFanatic

As many in this thread have suggested, there is a moral concern with preventing escalating behavior and what lesson "getting out of this ticket" sends to your son. Does it make him think in 3 years you'll bail him out of a DUi? a 2nd DUI? That's on you, and i can't pretend to tell you how to handle that.

On the legal side, it's a petty ticket. I never dealt with Amending/diverting Blue Springs municipal courts tickets, but patteeu in the thread earlier was correct, that some KC area jurisdictions (particularly in Johnson county) have 2 sets of rules 1 for those with attys and one for those without. If Blue Springs is like that then you may want to investigate that. Many jurisdictions will not divert or amend on school zone tickets some will just charge you double.

If they will amend or divert, it comes down to a financial calculation between the projected expense of the diversion/amendment and the amount your kids insurance rates will go up for the next few years should he receive the ticket. Best to ask your car insurance agent a hypothetical about that. They are usually helpful in answering that. Some policies have a 1 ticket forgiveness, some do not.
Good post.

I'm not sure how it works elsewhere, but I have a friend who went through the Speeding in a School Zone ordeal about five years ago in Johnson County. Hired an attorney to get the ticket changed/reduced to no avail. She had a clean record but since it was in a school zone the judge wouldn't change anything. She was out attorney fees AND had to pay the fine. I don't know if that's common practice or the judge was just being a jerk that day.

honestly, I would just pay the fine. No use going through all this trouble. for what? 14 over? did he hurt anybody? did he lose any points off his license? Is your son okay?

Those are the things you should look at. Paying a fine for 14 over is peanuts. It prolly won't effect his insurance that much. These little tickets are like a little scratch. Absolutely no use worrying about them. No biggie at all.
It doesn't have to hurt your insurance too much to end up costing you more in the long run.

Surely we have an insurance guy or two around here who can explain whether a first ticket of this kind is likely to have any impact on premiums and if so, how much.

JFC.

You really need to shut the **** up.
It *was* kind of a dickish move by GodofThunder to threaten to take this issue back into real life, though. Spouting off on the internet is one thing, but who knows what kind of real life BS might have come from turning a bunch of Blue Springs cops onto ChiefsFanatic's online rant. I see that GodofThunder has cleared it all up though so it's all good.

What's said on ChiefsPlanet ought to stay on ChiefsPlanet (or at least within the ChiefsPlanet family) unless its something truly extreme, IMO.

Insurance will skyrocket if you dont fight it and keep it to zero points.Male under 25 with a speeding ticket in a school zone equals Money time. You are gonna get hammered. Bad Karma for you.

In Pennsylvania, only the State Troopers are allowed to use a radar gun. Local cops have to use the timing method. Is that the same for wherever you're from?

I would also add, there's probably a value to maintaining that ticketless buffer zone, should this offense go on his record and the next offense can't be diverted or amended. His points may go over on his license, or it may have a cumulative impact on the rates. IMO, For most people, it's best to just keep it clean.

Next time I will be sure to add my [Sarcasm] [/Sarcasm] brackets for the Sarcastically Challenged. Do those people have a ribbon, or a color that I could display with each sarcastic post, making it very easy for these unfortunate people to get the full enjoyment from ChiefsPlanet.
