If someones dog killed my dog and then I got hurt to boot.. THEN.. asks for $3700... I'm not paying for jack shit..
We had the same situation at the City of Liberty MO.. Lateral line run behind neighbors houses with each house connected to it. The City took responsibility for it because it was technically part of our sewer system. I ran a new 8"main with manholes and made the service connections paid for by the City of Liberty because the old lateral was failing. Easements had to be obtained to do the work because the old lateral was so close to the houses and the new line had to go just inside property lines. Easement acquisition was tricky because some homeowners said they didn't have any problems so why do the work and mess up their yard. I explained that it was just a matter if time before it failed and backed shit up in their houses. Had Video of the pipe to prove it. I know this because I head the Utilities Constuction division for the City..

I would imagine that those sewer lines would be grandfathered since you both came after they were in the ground. It kind of sounds like you are one of "those" neighbors that so many talk about on here.

Since sewage lines are property of the home/land owner should there have been something in the title when you purchased the home? If not, shouldn’t this be considered illegal and really no different than say him tapping into your power lines or water lines?
Guess you might have to show proof that he knew of this for legal action but now that you know of this you need to have him put in his own line because if you ever sell your home and don’t disclose this you could be screwed. I see no option for you but have him put in his own line |

I hope you are not a lawyer. Somewhere when property was sold and and title reports were searched it would have showed up that an agreement had been made. Hand shakes by former owners don't hold up if there is no document to be found on this. Especially if they are now not on this earth any longer. The Title Company would have redflagged this if there was documentation.
