What would you do ?

Let me back it up here, I've always suspected that the backside of neighbors house had a sewer line or even the main sewer line coming across into my lateral line. Years ago, they allowed landowners with multiple houses together to share the same lateral line. Now I have the proof, his line does tie into mine, matter of fact, it's right up under the deck of my house.

Backing up to 3 years ago, I had to replace about 80% of my lateral line from the bottom of my circle drive to the main city sewer line. That cost me $ 7500.00 and I didn't replace it all because I didn't want to dig up my blacktop drive at the time.


My neighbor has turned into a childish dick ever since his dog followed my dog back to our property and our other dog killed it. To add insult to injury, he slipped on the wet grass and broke his collar bone.

So my question is, do I make him pony up $3750.00 or have him put in his own sewer line, approx. 130 feet ? I would be willing to bet that 130 feet will cost him at least $10K to put in !

Even after I apologized to him the next day, expressing my sorrow for his dog and his personal injury that was sustained on his property turned into an ass. Nothing worked, he kept on starring at us as we took our pets out on a leash, video us, making threats, playing loud music all day (which I didn't care, we like the same music) even after hours outside. He even started playing the same song all day long, for 16 hrs out of the day! Sad part is, we always got along up to this point, I used to mow his yard for him. He retired as a prison guard, was having some medical issues and a couple of weeks prior to this dog incident, he apologized for being a " asshole " about treat us and anybody around us. I told him then not to think twice about it, that I knew something was up with his demeanor. But this incident flipped him out, he put No Trespassing signs on the trees, paid for a survey crew to mark his property and has put up a fence between us, all within his rights. Please keep in mind, this whole time he had acted like an ass (over medication & emotional duress) I never engaged in his comments and told the kids to not comment. (This attitude of his has gone on for 5 months now and I'm about to send it into orbit).

Keep in mind when we both bought our houses, me in 1998 and he in 2010 , we were not aware of the current sewer line issues or how it was installed back in the 1930's.

Which brings us to date, he dug up a section of my yard to cut into a sewer tile that runs under my deck, to get to my sewer line. (FYI, there is only 10-12 feet between our houses) This line connects between my house and a clean out trap I had installed about 6' from my house. So his line is within 2, maybe 3 feet off the corner of my house! Then it runs about 60' out to the end of my driveway where we put in a cleanout trap and the new line starts, 90' to the city sewer main.

Years ago back in the 30's when both of these houses were built, the same guy that owned the old tobacco warehouse across the street had our houses built to help house the people that worked there (plus the many more on this street). They were boarding houses back in the day, reason they were built side by side, so close on the same sewer line. Building codes were so much different then than now and all of this old tile is giving way! I feel it's just a matter of time before the section between what we did and the house gives in under my blacktop drive.

I need to do something about this scenario with a 1-time, somewhat friend that has turned into a dickhead over pets!

Since I have not approached him yet, I'm leaning towards just letting him put his own line in. But I was wondering if there was another option here for him, cuz we are going to have to revisit this sewer line again. So I was thinking about getting him to own up to 50% of the maintenance is only fair.

sounds to me like one dog was on the neighbors property first, or at the very least in a common area both loose.

Well if there is a document on this on the lots I am pretty sure the city to keep the epa off there ass would gladly fix this problem as KMan did. In the end the two land owners need to talk and come to an agreement its in boths interest.

The law doesn't look at pets as part of the family they are property. This happened on OP property perhaps op can get compensation for mental anguish and suffering for his pet. That pet must be going through nightmares that he was forced to murder this intruder.

A little secret here! When you have a professional land surveyor do a sealed legal survey on your property have it recorded with your county Recorder or Deeds. You can request the PLS to do this for you but he will charge you dearly as it takes many hours out of his day and will charge you his hourly fee. To have your survey recorded is not required by law. You can have a copy the is signed and sealed buy the PLS. They usually give you 6 copies take it to your county recorder and have it recorded for posterity for a small fee. Your Title lone survey is not a legal survey its meaningless its sufficient to guarantee a tittle lone. The certificate will be affixed with a seal that says for loan purpose only. NOT A LEGAL SURVEY you would be laughed out of court its not even worth a sheet of toilet paper. The Mortgage Lone companies and Title companies have a strong lobby in DC. Why back when they got it in law that transfer of land doesn't require a legal land survey and they argued that the transfer of land between rancher farmers etc should not have to pay for a legal survey to transfer land ownership and made up this BS Title loan survey. So no boundary corners are used instead its fence lines and splitting curbs or fence lines on public roads to find your property. Then they do a easement search over you property and its description that was recorded across your property. This practice is still in affect for even urban properties that can be sold by square feet. The professional engineers and land surveyors have tried and tried to change this title lone survey business for urban lands but that lobby is too powerful.

Many times the title lone survey is more expensive than a legal land survey but many folks never see that in the overwhelming amount of documents you are required to sign at closing. They always label it land survey in the documents. It is not its a loan survey that satisfies the security of the loan but is not a legal land survey. They go and hire a LS that specializes in Loan surveys and can pop out 8 to 10 in a day at 75 to 100 bucks a pop loan companies love him. They may charge you a 1000 dollars in fees from your mortgage lender and in the end you have nothing that is a legal survey in court. The guys that do these types of surveys are out of there garage surveyors who carry little insurance and rent their equipment. Keep their business for a year declare bankruptcy then register a new business under a new name and do it again. Easy money.

The way this is “framed” leads me to infer you may not (?) have handled this from the perspective of someone trying to be a good neighbor. It’s also possible you didn’t present the story with some pertinent details that would make me think differently.

Regardless the move is to try and mend fences and work out an amicable solution to the sewer line issue to whatever extent that is possible. I haven’t read all five pages in case this has been discussed.

An apology can go a long way regardless of fault which probably has shades of gray with respect to the dog issue not knowing all the details. I would be emotional and heartbroken if another dog killed mine and would definitely possibly act like a child if my neighbor was a jerk about it.

So, your dog wandered onto his property with no incident and then his dog follows your dog onto your property and your grandson’s dog decides to kill it? Did you have your grandson’s dog euthanized? Did you or your grandson offer to pay for a new dog when/if he decided to get a new puppy?

Your answers to these questions will determine who the asshole is in this scenario. Right now the odds are definitely tipping to show you as the asshole.

I did, but he wanted the lab put down cuz his dog followed him into our yard, not the pit, It literally made no sense.

I really think he lost his senses over this! He was just mad, didn't matter at first about the pit killing his dog, just wanted the lab put down, even though he wasn't aggressive.

So, by the time I had walked down to the end of the driveway (at the edge of the house to see what was going on), he was 15 feet across the property line doing what dogs do, licking and sniffing each other's ass's. I commanded him to come back across to my side, as he came back, the neighbor's pain in the ass Yorkie decided to follow him. Having artificial knees, I could not run to the property line fast enough to stop what was about to happen next. My grandson's Pit was there with his shock collar on, as soon as their dog entered 6' inside of our property, it was too late. It had been raining some prior to this time and the neighbor slipped as he tried to run downhill to catch his dog before crossing. He slipped and did a Charlie Brown flop on his back, landing in a way to break his collar bone. I got citated for not having my Lab on a leach, yet he was not citated for the same thing. But he took all of this personal, took the time to give the grandkids a hard time. Telling them, I'm going to kill all of your dogs. Even making threats towards the kid's friends. I had to call the police on him several times about it and even spoke to the Co. Attorney about his threats, causing fear within them. Even after I apologized to him the next day, expressing my sorrow for his dog and his personal injury that was sustained on his property turned into an ass. Nothing worked, he kept on starring at us as we took our pets out on a leash, video us, making threats, playing loud music all day (which I didn't care, we like the same music) even after hours outside. He even started playing the same song all day long, for 16 hrs out of the day! Sad part is, we always got along up to this point, I used to mow his yard for him. He retired as a prison guard, was having some medical issues and a couple of weeks prior to this dog incident, he apologized for being a " asshole " about treat us and anybody around us. I told him then not to think twice about it, that I knew something was up with his demeanor. But this incident flipped him out, he put No Trespassing signs on the trees, paid for a survey crew to mark his property and has put up a fence between us, all within his rights. Please keep in mind, this whole time he had acted like an ass (over medication & emotional duress) I never engaged in his comments and told the kids to not comment. (This attitude of his has gone on for 5 months now and I'm about to send it into orbit).

Keep in mind when we both bought our houses, me in 1998 and he in 2010 , we were not aware of the current sewer line issues or how it was installed back in the 1930's.

Which brings us to date, he dug up a section of my yard to cut into a sewer tile that runs under my deck, to get to my sewer line. (FYI, there is only 10-12 feet between our houses) This line connects between my house and a clean out trap I had installed about 6' from my house. So his line is within 2, maybe 3 feet off the corner of my house! Then it runs about 60' out to the end of my driveway where we put in a cleanout trap and the new line starts, 90' to the city sewer main.

Years ago back in the 30's when both of these houses were built, the same guy that owned the old tobacco warehouse across the street had our houses built to help house the people that worked there (plus the many more on this street). They were boarding houses back in the day, reason they were built side by side, so close on the same sewer line. Building codes were so much different then than now and all of this old tile is giving way! I feel it's just a matter of time before the section between what we did and the house gives in under my blacktop drive.

I need to do something about this scenario with a 1-time, somewhat friend that has turned into a dickhead over pets!

Since I have not approached him yet, I'm leaning towards just letting him put his own line in. But I was wondering if there was another option here for him, cuz we are going to have to revisit this sewer line again. So I was thinking about getting him to own up to 50% of the maintenance is only fair.
Those are useful details along with your follow-up answer about offering to put down the pit.

I guess it boils down to your read on the likelihood of his irrational behavior continuing or if there's a way to reason with the dude.

If you don't think there's anyway to bring him around then I think the move is to let him install his own line. It'll mitigate your interaction with an irrational person moving forward & simplify an aspect of your life.

It actually makes perfect sense. Your dog got his killed so he wants yours put down so you have to deal with the same loss as him.

Could this have been avoided if you just bought another shock collar? Because if I had to guess you gave your dog’s collar to the psycho dog and let your dog run loose.

Not trying to be a dick, but if your houses are only 10 to 12 feet apart, I am having a hard time visualizing the whole dog killing/broken collarbone incident in the huge paragraph discription of things.
