Are there any actual lawyers on ChiefsPlanet?

I think I need to hire a lawyer for my 16 year old son who got a speeding ticket for going 34 in a 20 school zone.

It is a church school that he didn't realize was a school, and on the description on the ticket, the officer clocked him before he was even 10 feet into the school zone. And he was sitting there waiting for a high school kid, because high school had just let out. I have literally driven down this road over 50,000 times in my life, at all times of day and year, and have never seen cop checking speed in this school zone.

The cop could have seen how nervous my son was, and been understanding about his lack of knowledge of the school, but he wasn't.

So, I need to hire a lawyer, and thought I would ask here first.

If you are not a lawyer, maybe you could recommend someone.

Thanks,

ChiefsFanatic

So, he wasn't speeding?

Again, is there any personal responsibility in your household, at all?

You know, I've never heard so many excuses from someone claiming that they weren't making excuses.

You're pathetic.

You're on a public forum and you're not only insulting the Blue Springs Police, you're justifying speeding in a school zone by stating that it's "really not a school" and "he's just a kid", etc.

Then, someone with connections to the Blue Springs police force posts and you suddenly become a jellyfish.

JFC.

You really need to shut the **** up.

Don't get me wrong man, I'm really not a cop hater. Overworked, under appreciated, and underpaid. I just really sensed a threatening tone in your post, and thought you were a cop as well. I hate that combination. I don't think him calling them dicks would constitute a threat but that's just my opinion. I don't really know. He was definitely venting. As far as cops not getting tickets, lol, we all know that's true. You seem like a pretty good guy, I apologize for flying off the handle. Abuse of power on any level is a strong issue for me. Particularly by folks we trust to protect and serve us.

Hey man, no hard feelings, I sent him a PM saying that I would in no-way send them anything he had written. I understand that he was venting as was I when I was 'in my eyes' protecting some of my family members who serve with the police force.

Sedated, your driver's ed teacher was a moron:

And that's totally understandable too. I would probably do the same thing in your situation. I just didn't want to see the guy get any real life grief for venting about it online. I'm glad it all worked itself out, and hopefully his kid will gain some positive lessons and experience from the whole thing.

Eh, my kids won't be driving for a couple more years, but when they do, I know my insurance will probably double, and any ticket they get will further kill my rates. If I can schmooze them a fine, but avoid getting my rates jacked? It's a win/win.

I'm not a MO licensed Atty, which is what you would need, but it basically comes down to 2 choices, financial and moral.

As many in this thread have suggested, there is a moral concern with preventing escalating behavior and what lesson "getting out of this ticket" sends to your son. Does it make him think in 3 years you'll bail him out of a DUi? a 2nd DUI? That's on you, and i can't pretend to tell you how to handle that.

On the legal side, it's a petty ticket. I never dealt with Amending/diverting Blue Springs municipal courts tickets, but patteeu in the thread earlier was correct, that some KC area jurisdictions (particularly in Johnson county) have 2 sets of rules 1 for those with attys and one for those without. If Blue Springs is like that then you may want to investigate that. Many jurisdictions will not divert or amend on school zone tickets some will just charge you double.

If they will amend or divert, it comes down to a financial calculation between the projected expense of the diversion/amendment and the amount your kids insurance rates will go up for the next few years should he receive the ticket. Best to ask your car insurance agent a hypothetical about that. They are usually helpful in answering that. Some policies have a 1 ticket forgiveness, some do not.

I look at it like this: First off, my rates are gonna get jacked. No doubt. They'll probably be horrible while they're under my policy. I'm expecting that.

But secondly, it's part of life. Everyone gets a speeding ticket, especially when they're young. Fortunately, I haven't had a moving violation in more than 17 years (which means I'll get one tomorrow!) but I've plenty of parking tickets in Los Angeles, which add up really quickly at $55 dollars a pop.

The bottom line is that there is NO WAY I'd come into this forum to bitch about a ticket, let alone insult and bash the Los Angeles Police Department in any way shape or form. It takes a special kind of man and/or woman to be a police officer (just as it does to be a firefighter) and I'm a not going to insult or take one of these people to task because I or a family member got a justified traffic ticket.

That's just immature and asinine.

You're right, I wouldn't bring it to this forum.
But I would do everything else I could to salvage my insurance rates. BTW my kids WILL pay their own goddam fines.

It is such a corrupt system.

Either you're going to pay an attorney a few bucks, in which he'll "spiff" the judge in order to get the violation reduced for 4 times the amount of the ticket, or you pay the insurance company a higher rate because the driver is deemed "at risk".

Either way, you're out the dough.

Yup, it's a matter of which costs more.
Kids do screw up. All we can do is try to correct them and make them decent citizens, without screwing ourselves in the process.
